Sales
tax
Currently,
only Washington state residents are subject to sales
tax collected by Vitalady.
Change
in Washington State Sales Tax for orders picked up
or delivered in Washington State.
Washington
State law changed regarding how we collect sales
tax. It is based on the tax rate where the product
is delivered, not from where it is
shipped. Due to the limitations of our shopping
cart, those customers, for whom Washington
State Sales Tax is applicable, our shopping cart will
be showing a flat 9% Sales Tax and adding that
amount to your order. If the product is
delivered where a lower tax base is collected,
i.e.: 8.8% here in Pierce County, we will show
the correct amount charged on your final
invoice.
We
regret this inconvenience and will continue to seek
a less cumbersome way to provide accurate charges
through out the transaction.

(Please
note: In cases where an amount may need to be increased
or decreased due to an order change or price adjustment,
some banks may withhold the initial authorization
amount and the actual charge amount for a period of
time depending on your bank. Vitalady cannot be held
responsible for these transaction holds on your account.
They would need to be taken care of between you and
your financial institution.)

We
do not accept electronic checks at this time. For
your own safety, please do not send cash.
We
reserve the right to withhold shipment until payment
transaction has been completed.
There
is a $10.00 minimum product purchase per order, plus
appropriate Shipping and Handling Fees.
Due
to recent increase in the number of NSF Checks we
have received, your shipment may be delayed until
your check
clears and funds are deposited into our account which
may take up to 5 business days after we deposit it.
Returned
Check Fee.
A $30.00 fee will be assessed for
any check returned
to Vitalady, Inc. for Non-Sufficient Funds.

We
ship using UPS or FedEx Ground service.
You may select one at checkout, or indicate
"No Preference".
There is no difference in shipping cost
for either service.
(NOTE: US Postal Service is used for all packages
under 2lbs. and shipments to outside the Continental
United States!)

Recycled
Packing Materials
Don't
be alarmed by what it says on the outside. It’s
what’s on the inside is what counts.
We
recycle as many materials as possible. We reuse the
boxes from incoming products. We might need to cut
them down to size, but hey, it is better than sending
them to a landfill. Also, we don't have to use EXCESS
packing materials. We even recycle the bags that you
bring to us for pickup orders! Packing paper that
comes to us from a local college library comes in
plastic bags, which we use to recycle our plastics
and cardboard pieces. And then we even reuse those!
Of course, we recycle our newspapers. Children can
use the library paper to create art and newspaper
for Paper Mache, so you can recycle it too, wow.
We
buy boxes that are overstock or misprinted so if it
says you received a box of frozen fries, don't be
alarmed. Even the packing peanuts are recycled and
not fried! ALL packing materials are checked for cleanliness
and are of a strength to handle being tossed around
by UPS or FedEx and even the Post Office to ensure
safe delivery of your order.
We
shop for and purge our unused boxes and pallets on
www.freecycle.org
. It's a national online forum to keep “too
good to toss” items out of landfills. Check
for one in your area! We’ve recycled a copier,
ink cartridges and received even more things in return.
NOTHING goes to waste!

To
compensate for our annual trip to the conferences
in our RV, we drive a Prius at home. We are
as green as we can be! To
quote Kermit, "It isn't easy being green.”
We do it because we care and
hope you'll continue by recycling or freecycling
your plastic jugs, bottles and packing materials! |
New
Back Order Policy
We
make every effort to have sufficient inventory to
fill every order. In the event that your demand
exceeds our normal inventory levels, or if our suppliers
unexpectedly backorder a product, the following change
in policy will apply.
Effective
with orders placed 1/01/09 and after, the following
policy regarding out of stock items will go into effect.
It is our hope to service your essential nutritional
needs better and faster. For those orders shipped
within the lower 48 States, excluding those
shipments to APO, FPO, Hawaii, Alaska, and all export
shipments:
Our
main focus will be on essential items such as Vitamins
& Minerals (Class 1000 Items) and Protein (3000
Class Items). Any order for multiple items,
we will ship all items we have available. If
we are out of stock on any of these items you will
be notified with an estimated shipping date.
Those back ordered items will be sent as soon as they
arrive at no additional charge to you.
Any
out of stock non-essential items such as Herb and
Specialty formulations (Class 2000), Protein Samples
(Class 4000), Protein bars and Snack (Class 5000),
Syrups and Sauces (Class 6000) and Accessories (Class
7000), will be cancelled from the order. We
will notify you by email of any cancellation.
Due to the non-urgent nature of these items, we request
you order them at a later time.
On
orders placed with a credit card, we will have to
charge the card one time for the items shipped and
those back ordered. We do not receive your whole
card information, so we can only charge once per order.
Any order containing non-essential out of stock items
will not be charged for them.
If
you prefer us to hold an order until it is complete,
please indicate that in the order comment line.
The
key to this will be communication. We will notify
you by email so please provide us a frequently
monitored email address. If you prefer us to
call or to give us a credit card number for any back
ordered items, please indicate that on the order comment
line.
For
orders shipping to Alaska, Hawaii, FPO, APO addresses
or export shipments, we will continue to hold all
orders until we can fill them complete and notify
you by email with an anticipated shipping date.
If you prefer to have us make multiple shipments it
will be at your expense. Please indicate a preference
on the order comment line.
It
is truly our hope this will improve our service on
the items needed to maintain your health and help
you on your weight loss journey. If you have

Export
Shipments
(Does not apply to shipments to FPO and
APO addresses)
We
are starting to ship to Canada, Australia, most Western
Europe countries and other countries on a order
by order basis. The customer must assume all additional
costs (shipping via Parcel Post.) We will advise shipping
cost after we pull and weigh the order. We require
your approval for this expense, prior to shipping.
The domestic shipping schedule posted on our
web site is not applicable. All duties/fees
collected by Customs Agencies/Brokers are the responsibility
of the customer. Any product returned for Customs
Refusal will be credited to the customer, less all
shipping costs.
Due
to the difficulty of sending liquid product through
the Parcel Post System, we will not be able to supply
any premixed liquids, (Cheramino, SciFit Amino Infusion
5000, Syrups, Amino Sculpt or Scargo). With the
current state of world affairs, we can not be held
responsible for delivery of your order. The customer
assumes responsibility with proof of insurance and
shipment by the US Postal Service.
We
are not able to accept orders for export on protein
samples. Due to the lack of data on our labels for
samples, these can not be, or may cause problems in
customs. All orders that include samples for
export will be delayed until we are able to notify
you.
We
will review restrictions on shipping to the requested
location. Orders for items that are restricted,
the customer will be notified and will not be sent.
All
items sold are assumed to be for personal use. Orders
placed for resale will be cancelled. Payment is to
be is US Funds. We reserve the right to hold shipment
until payment clears if paid by check. Every
order for export will be reviewed and is subject to
our acceptance. If we choose to not accept
an order, the customer will be notified by email.
Damages
and Shortages
Merchandise
damaged during shipping or shortages (missing items)
must be reported to Vitalady within 24 hours of receipt.
All damaged merchandise must be kept in the original
packing for 10 days in case UPS wants to inspect the
shipment. We will contact the shipping company for
visual inspection of the merchandise and box. We will
then issue you credit for the amount of any confirmed
damaged or missing merchandise.
Returns
You
must contact us during normal business hours for a
Return Authorization Number prior to returning any
merchandise. Please have your invoice number available
when you contact us. Merchandise must be returned
at your expense, unopened and in perfect resalable
condition in order to receive credit. The Return Authorization
Number we supply you must appear on the package shipping
label to expedite your appropriate credit.
We will issue full credit for product returned as
required above if returned within 10 days of receiving
your shipment. For merchandise returned from the 11
to the 30 day after receipt there will be a 25% restocking
fee applied and deducted from the invoice amount.
On the rare occasion that we may send an item other
than what was ordered, DO NOT OPEN THE PRODUCT, or
it will void your right to return it. Please check
each shipment as soon as you receive it and advise
us of any discrepancy within 24 hours after receipt.
Manufacturers occasionally change their production
methods and or suppliers, resulting in slightly different
flavor. Returns for this reason will be upon our receiving
the manufacturers agreement.
We will not issue credit for the following regardless
of the reason for return:
- Product
returned without prior authorization.
- Product
that has been opened or that is in other than
resalable condition.

Protein samples, or snack products. We sell
these in small quantities for you to try.

Product not purchased from us or that can
not be substantiated by an invoice

Pack
all returns carefully!

litigation, dispute, or other claim which may
arise from the purchase, sale, advice, use or
involvement with Vitalady shall be settled in
accordance with the laws of the United States
of America and particularly the State of Washington
and shall be heard and venued in the County
of Pierce. |
